CHAPTER 6
PROHIBITION FOR JUMPING AND/OR DIVING FROM COUNTY OWNED BRIDGES
TITLE IV - STREETS, ROADS, PUBLIC WAYS & TRANSPORTATION

 

SECTION 1.  TITLE
This ordinance may be known and may be cited and referred to as the "Jones County Bridge Safety Ordinance". -
 
SECTION 2.  PURPOSE
It is the purpose of this chapter to adopt a regulation to prohibit persons from jumping or diving from any County owned or maintained bridge or culvert into the water flowing beneath same.  The practice of jumping or diving from bridges poses a safety risk to the participants and to the vehicular and pedestrian traffic traversing the bridges and culverts.  Submerged objects, and non-uniform water levels, among others, may pose safety and health hazards to the participants. -
 
SECTION 3.  AUTHORITY -
The Jones County, Iowa, Board of Supervisors shall have the authority to regulate for the safety of the public in accordance with the provisions of 1997 Iowa Code Chapter 331.
 
SECTION 4.  JUMPING OR DIVING PROHIBITED
It shall be unlawful for any person to jump or dive from any County owned or maintained bridge or culvert into the water flowing beneath same.
 
SECTION 5.  ENFORCEMENT PROCEDURES
It shall be the duty and responsibility of all law enforcement officials to enforce the provisions of this regulation. This ordinance may be enforced by issuing a civil citation for violating the County Ordinance.
 
SECTION 6.  PENALTY  -
Violation of this ordinance is a county infraction pursuant to Iowa Code Section 331.307, punishable by a civil penalty of $100 for each violation. -
 
SECTION 7.  REGULATION EFFECTIVE UPON PUBLICATION
This ordinance, and any amendments thereof, being deemed essential and imperative for the preservation of public safety, shall be in force and effect from and after its passage and publication as provided by law.
